TERMS & CONDITIONS
THIS AGREEMENT CONSTITUTES AN ORDER FOR WEDDING PHOTOGRAPHY AS AGREED TO BY BOTH PARTIES: The Photographer (Stuart Harrison Photography) and Contracting Party (The Client). It is mutually agreed that the photographer shall provide services and/or goods as specified and that the client shall pay the photographer the amount due for the said services and/ or goods on the due date agreed by both parties.
BOOKING/PAYMENT: Your wedding date will be held for 21days after I’ve received back a booking form. This booking form will be signed and sent back to you with a booking fee invoice for £200 within 7 days. ONLY WHEN I HAVE RECEIVED YOUR BOOKING FEE WILL YOUR WEDDING BE BOOKED WITH STUART HARRISON PHOTOGRAPHY. YOUR WEDDING BOOKING IS AT RISK IF THE BOOKING FEE IS NOT PAID WITHIN 14 DAYS. A balance payment is to be made no later than 30 days prior to the Wedding Ceremony. Payment for additional albums, photographic prints outside of the agreed wedding package are made after the wedding, at the time of ordering. (THE BOOKING FEE IS NON REFUNDABLE)
CREATIVE LICENSE: The photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. The photographer’s judgment on photographic style and the number of photographs taken shall be deemed correct. Style and number of photographs are also dependent on changes of the weather and the availability and willingness of subjects. The photographer will make best efforts to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
IMAGES: The number of images taken for each package is different. The number of guaranteed images per package is as follows Bronze Package-100 images, Silver Package-200 images and Gold/Platinum Packages-300 images. The photographer will only allow the edited images to be seen by the client. The photographer will not under any circumstances allow the raw images to be seen or sent to the client. The Photographers judgement will be deemed correct that the best images have been chosen as the edited images. The photographer reserves the right to use any picture/image taken for advertising, display, internet promotion, publications or other purposes. The photographer operates in compliance with the General Data Protection Regulations and your rights as a client are fully contained within the Privacy Policy on the website. The photographer commits to ensure there is no specific identification of individuals appearing in the pictures/images if chosen for use by the photographer for advertising, display, internet promotion, publications or other purposes. The client may use the pictures on social media or other personal literature and can electronically transmit the images to family or friends for personal use only but can not use any images for commercial purposes.
AFTER THE WEDDING: Your wedding images will be ready no later than Four weeks after your wedding. You will be sent a password protected wedding gallery which will include your edited wedding photographs. If your package includes a USB this will be posted/given to the client at this time. Any wedding albums ordered will take Six to Eight weeks to design from the time the client has instructed Stuart Harrison Photography that they are happy with the edited images. Any album ordered will take a further three weeks to print and deliver from the time the client is happy and has signed the wedding album proofs. Any delays will be notified to the client as soon as they are known.
UNFORESEEN CIRCUMSTANCES: In the unlikely event of total photographic failure, injury or sickness beyond the Photographer’s control, The Photographer’s liability shall be limited to a full refund of all monies paid. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged. In the event that the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the monies already paid.
CANCELLATION: If the photographer has to cancel this contract for reasons beyond the photographer’s control, (death, injury, sickness etc.), The photographer’ liability shall be limited to a full refund of all monies paid. If the client cancels for any reason after a period of 21days from the date of signing this contract you will be liable as follows: If your wedding is cancelled no sooner than 3 months before your wedding date you will lose the booking fee that you have already paid. Cancelling the wedding up to 3 months before your wedding date the full payment is due in full 30 days before the wedding date stipulated on this contract. Should the cancelled wedding turn out to be a postponement, then, subject to Stuart Harrison Photography’s availability, all money paid may be applied to the new wedding date. If Stuart Harrison Photography is unable to attend any new date the client states, the client will then lose any monies paid and is liable to pay the full outstanding balance.
